City Lodgings Terms And Conditions
These conditions apply to all bookings to the exclusion of all other terms and conditions,
including any terms and conditions that you may purport to apply. Your acceptance
of these conditions is acknowledged by accessing this site or otherwise making a
booking. Payment of a deposit or rental charge also indicates acceptance of these
terms and conditions.
1. General
a) we or us means City Lodgings Limited of 18 Snig Hill, Sheffield, South Yorkshire,
S3 8NB (Company Registration number 06558796)
b) you means the person (being an individual, firm or corporation) accessing or
using this site, choosing to make a booking with City Lodgings Limited or otherwise
paying a deposit or rental charge to City Lodgings Limited
2. Booking
a) All rates are per apartment and are in UK pounds sterling.
b) Bookings can be made by in person, by telephone or online by persons over the
age of 18. A booking is deemed confirmed once full payment has been received for
bookings of 7 nights or less, or a deposit of has been paid for bookings of more
than 7 nights. In addition, a completed booking form must also be completed and
returned to our office before a booking is deemed to be confirmed.
c) We will take all reasonable steps to ensure that the requirement of each reservation
are met to the best of its ability.
Payments
a) we accept, cash, company cheques, bank transfers and debit and credit cards.
Corporate customers are eligible to apply for a 30 day credit facility, however
this is completely at our discretion. A company credit check will be carried out
upon receipt of a credit account application form.
b) Payment for the first 2 nights is payable at the time of booking as a deposit
c) Any outstanding balance is payable no later than 7 days prior to commencement
of the booking.
d) Where payment is received in the form of cash, photo id is required. With company
cheques, valid credit or debit card details are required for security purposes.
e) If any payment is not made by you on the due date, we shall be entitled, without
limiting any other rights we may have, to charge interest on the outstanding amount
(both before and after any judgement) at the rate of (6%) above the base rate from
time to time of (Barclays Bank Plc) from the due date until the outstanding amount
is paid in full.
4. Cancellation and Alteration
a) Cancellations should be made within 48 hours of arrival and should be sent in
writing to City Lodgings Limited, 46 Wostenholm Road, Sheffield, S7 1LL or by email
to info@citylodgings.co.uk. The booking will be deemed cancelled on the day the
written cancellation arrives at our office.
b) If we receive the cancellation notice within 48 hours of arrival. Any monies
paid will be returned less a £35.00 handling and administration charge. If the cancellation
notice is received less than 48 hours prior to arrival or you fail to arrive for
your booking, any monies paid will be retained in full. Once a booking has commenced,
if a guest leaves the accommodation prior to the departure date, they are not entitled
to any refund.
c) If you wish to alter your booking (e.g. change the date of your stay or the accommodation
requested) we will use all reasonable efforts to comply with your request, however
we cannot guarantee that we will be able to do so and we accept no liability for
any loss, damage or additional expense that may be incurred in that circumstance.
In addition we may charge, at our discretion, an amendment fee of up to a maximum
of £35.00 per apartment to cover the necessary administration costs incurred.
d) In exceptional circumstances we may find it necessary to cancel your booking
and if so, we shall make all reasonable efforts to offer a suitable alternative.
If this is not acceptable, and subject always to clause 13, we will refund any sum
you have paid to we which shall, subject always to the first paragraph of clause
14 below, constitute full and final settlement of any liability we may have to you
as a result of such cancellation.
e) If it is necessary to alter the confirmed itinerary before departure, we will
use all reasonable efforts to notify you as soon as possible. Subject always to
clause 12, if these alterations are unacceptable you may cancel that part of your
booking that relates to the alteration and receive a full refund for that part your
booking, which shall constitute a full settlement. If, in this circumstance, you
wish to cancel that part of the booking which is affected you must inform us within
3 days of receipt of the notification of variation. Failure to do so will be deemed
as acceptance of the variation.
5. Occupants
a) Only people notified to us prior to arrival may occupy the apartment.
b) You may not re-let / sublet the apartment to any other third party without our
prior written approval.
c) The number of people permitted to occupy the apartment is limited to the number
of beds available and this limit may not be exceeded without our prior written consent.
d) We reserve the right to refuse admission to the apartment if this condition is
not complied with.
6. Check and Check-out
a) You may check in to your apartment from 2pm onwards. Check out time on the day
of departure is 11.00am
b) Keys may be collected from our designated reception desk, the address of which
is indicated in your booking confirmation. The Reception desk is open between the
hours of 2pm and 5pm. Guests who have prearranged to check in after 5pm will be
given instructions of how to check in, which may involve using one of our automated
check-in facilities.
c) If there is a delay in vacating the apartment beyond the agreed time, a full
days rental may ne charged to you.
7. Facilities and Services
a) The price of your stay includes, rental of the apartment, all related utilities,
Broadband Access for a laptop and once weekly housekeeping service including linen
and towel changes.
b) Telephones calls are charged as additional extras. The call charges tariff is
clearly displayed in each apartment. We also operate a dry cleaning service, charges
and information are clearly displayed in each apartment.
c) A valid credit or debit card is required for every booking as a security measure.
We will not process any charges to the card unless it comes to our attention that
an item of furniture is damaged or missing or the apartment is vandalised or left
in an unacceptable state. An invoice detailing the charges will be forwarded to
the address you provided on the booking form.
d) Wireless internet is provided free of charge for our guests to use on a CASUAL
basis. Downloading movies and other large files is not permitted and excessive usage
may be charged for.
e) Any mini-bar facilities used in the apartment may be paid for by leaving the
exact change in the apartment, or paying at reception. Items used and not paid for
will be charged to the card used to make the booking. Replacing the items used by
alternatives that do not match exactly what was taken, will also be charged for.
8.Usage
a) The apartment is to be used for residential purposes only. Normal home working
is permitted but the apartment is not to be used for any business purposes that
would increase the flow of people to and from the apartment or otherwise disturb
surrounding residents.
b) The apartment is not to be used for any illegal and / or immoral purposes.
c) You agree not to keep any of the following in the apartment or in any other area
of the apartment block:
i) pets or live animals of any description;
ii) articles or liquids which are dangerous, noxious, flammable, explosive or which
may give rise to a health or fire risk;
iii) firearms;
iv) any illegal goods, including drugs;
v) anything unlawfully in your possession; or
vi) anything specified as prohibited in any written list or notice, which may be
issued from time to time by us.
d) Any electrical equipment brought on to the premises by guests, must be in a sound
condition and comply with current British standards. Any damage caused to our apartments
as a result of faulty electrical goods brought in by guests will be the sole responsibility
of the guest and they will be liable for any charges incurred. City Lodgings reserves
the right to ask a guest to remove any item electrical or otherwise that City Lodgings
staff deems a threat to safety
e) Smoking is not permitted in the apartment or any other part of the apartment
building. No naked flames are permitted anywhere on the premises. Guests not complying
with this condition may be asked to leave immediately. City Lodgings takes fire
safety very seriously. Any fire fighting equipment that is interfered with on a
non emergency basis will incur a £50.00 fine and the guest will be asked to leave
immediately. Criminal prosecution may follow On arrival guests are asked to familiarize
themselves with the fire action plan on the back of the apartment door
f) The apartment and all equipment, utensils, furniture etc must be left clean and
tidy at the end of your stay. Failure to do so may result in additional charges.
g) You agree to ensure that nothing is done which may jeopardise our insurance policy
or any part of it in respect of the apartment and its contents.
9. Damage
a) We are not responsible for any loss or damage to your goods or personal belongings.
We recommend that you obtain the appropriate insurance cover for loss or damage
to your goods or personal belongings during your stay.
b) You are responsible for taking all reasonable care of the apartment and its contents.
c) Except in the case of normal wear and tear, you are responsible for any damage
to the apartment or its contents during your stay, which has occurred due to the
negligence, wilful default or irresponsible behaviour on the part of yourself or
those occupying the apartment or their guests. Any damage must be reported to us
by you, without delay. Without prejudice to any other right or remedy we may have,
you may be charged in full or part of it, if you do not leave the apartment in the
same state as it was in upon your arrival.
d) Carparking - we accept no liability for any loss or damage to vehicles which
are parked either off-road or in any of our carparks whatsoever.
10. Rights of Access
a) We, or our authorised agents, may at any time access the apartment for the purpose
of inspection of the apartment, and to carry out repair or maintenance work.
11. Security of Tenure
a) As the apartments are used as serviced holiday accommodation, they are exempt
from security of tenure legislation.
12. Information
a) All information supplied to you by us, is given in good faith and is based on
information reasonably available to us at the time. All errors and omissions are
accepted. Whilst all reasonable efforts have been to ensure the accuracy of any
such information, we will not, subject always to the first paragraph of clause 22
below, be liable, for any inadvertent inaccuracies in such information.
13. Force Majeure
a) We will not be liable for any delay, loss damage or expenses incurred if your
booking needs to be altered or cancelled or we are unable to perform our contractual
obligations as a result of events beyond our reasonable control, which shall include
but not be limited to events such as war, civil strife, terrorist activity, labour
disputes, natural or man-made disaster, fire, flood and adverse weather conditions.
14. Warranty and Liability
a) Nothing in these conditions shall affect your statutory rights. More specifically,
nothing in these conditions shall restrict our liability for death or personal injury
caused by our negligence, or fraudulent misrepresentation.
b) We warrant to use all reasonable efforts to ensure that your chosen accommodation
is properly arranged and is of a reasonable standard. You must immediately notify
us of any complaint, and in any event no later than 24 hours after your departure
and, if we are found to be in breach of this warranty, we will at our option either
provide you with a replacement apartment (if reasonably practicable) or refund to
you the price paid by you to us.
c) However, we shall not be liable for the actions or omissions of property owners
(where the property is not fully owned by us), or of any other third party.
d) In no circumstances shall we be liable to you, in contract, tort (including without
limitation negligence) and/ or breach of statutory duty, or otherwise, for any losses,
costs, claims, damages or expenses including without limitation loss of profits,
revenue or income (whether actual or potential), loss of business (whether actual
or potential) or for any indirect or consequential (including economic) loss of
any kind.
e) Our total liability to you howsoever arising as a result of or in connection
with your booking shall be limited to the total amount paid by you to us for such
booking.
15. Law, Jurisdiction and General
a) These conditions and all matters arising in relation to your booking shall be
interpreted, construed and enforced in all respects in accordance with English law
and you and we each irrevocably agree to submit to the exclusive jurisdiction of
the English Courts over any matter or claim arising from or in connection therewith.
The place of performance shall be England.
b) If any provision of these conditions is held to be unlawful, void or unenforceable
then that provision shall be deemed deleted and shall not affect the validity and
enforceability of the remaining provisions.
c) No failure by us to exercise any of our rights under these conditions shall operate
as a waiver of our rights.
d) The contract between us and you is for the sole benefit of you and us and is
not intended to confer any benefit upon any third party whether under Contract (Rights
of Third Parties) Act 1999 or otherwise and no third party shall have any right
to enforce such contract.
e) Your booking is personal to you and us and you shall not assign or transfer it
in whole or in part.
16. Privacy
a) We take your privacy and confidentiality seriously. We collect (a) information
necessary for us to process your booking and (b) information derived from “cookies”
(described below). We use cookies to monitor site usage and related information.
b) “Cookies are a small piece of data created when you visit a website. This data
is sent from our web-server to your computer and stored on your hard-drive. You
may be able to set your web-browser to refuse cookies but this may mean you have
to re-enter information and preferences each time you use our website.
c) We will try to up-date your information as often as possible to keep it current,
accurate and as complete as possible. However, we provide no warranty or guarantee
and bear no liability to you in the event that any data transmission over the internet
is not completely accurate or secure.
d) We use your information to help us improve our website and our service, to personalise
the types of information you receive from us, as well as for internal statistical,
marketing and administrative reasons. We do not share this information with outside
parties except to the extent necessary to process your booking.
e) By using this website, and supplying us with your information, you consent to
use by us of your information as described above.
